Trademarks and Copyrights
By submitting a design to Blu Prime Playing Cards, you warrant and represent that you are the sole, legal owner or licensee of all rights, including copyright, to each copyright, service mark, trade name, trademark, logo, portrait, graphic, artwork, statement, photograph, picture or illustration of any person or any other intellectual property included in such design.

Further you warrant and represent that no part of the design: (1) is the subject of any notice of such infringement you have received; (2) violates or infringes upon any common law or statutory right of any person or entity, including, but not limited to, rights relating to copyrights, trademarks, contract rights, moral rights or rights of public performance or (3) is subject to any restriction or right of any kind or nature whatsoever which would prevent Blu Prime Playing Cards from legally reproducing the images or text submitted.

You agree to defend, at your sole expense, any claim, suit, or proceeding brought against Blu Prime Playing Cards which relates to, or is based upon, a claim that any portion of the design infringes or constitutes wrongful use of any copyright, trademark, or other right of any third party, provided that Blu Prime Playing Cards gives you written notice of any such claim and provides you such reasonable cooperation and assistance as you may require in the defense thereof. You shall pay any damages and costs assessed against Blu Prime Playing Cards pursuant to such a suit or proceeding. Further, you agree to indemnify and hold Blu Prime Playing Cards harmless from and with respect to any such loss or damage (including, but not limited to, reasonable attorneys' fees and costs) associated with any such claim, suit or proceeding.

All items shown on advertising material published by Blu Prime Playing Cards containing corporate logos or registered trademarks are shown only to illustrate the logo reproduction capabilities of Blu Prime Playing Cards. Purchase of merchandise from Blu Prime Playing Cards in no way grants you permission to reproduce logos, nor does it transfer, grant, or lease ownership or license of any logos or trademarks to you.

Right to Advertise
You may declare when you place an order that Blu Prime Playing Cards may not use the product resulting from your order in self-promotion. However, unless you specify this, Blu Prime Playing Cards reserves the right to use the product resulting from your order or images of it or them in self-promotion.

Return Policy
You must register any complaint within 15 days of receiving the finished product. However, in no case do we guarantee refund, either in whole or in part, or a return allowance. Please discuss your complaints with a member of the staff of Blu Prime Playing Cards when they arise. We strive everyday to meet the exact needs of our customers and we commit to handling your needs with respect and urgency, no matter what they may be.

Orders are shipped from our facilities in China, our logistics partner's warehouse in Los Angeles, our logistics partner's warehouse in Vancouver, Toronto, or Chicago. Please see the product information pages to find out the FOB point of your product. We reserve the right to modify the origin shipping location of your product; if we do, your original shipping estimate will still be respected and applied. We are unable to ship on third party accounts for any orders being produced at our faster lead times. For longer lead time orders for which a third-party trucking company is desired, ensure shipping instructions have been provided to Blu Prime Playing Cards at least three weeks in advance of the estimated ship date.

Start of Order
The date at which the delivery time conveyed to you starts counting down is the business-day on which Blu Prime Playing Cards has successfully received all artwork, received confirmation of proofs, and received all payment required for the order for which that delivery time is applicable.

Overruns / Underruns
We aim to ship exact quantity, or slightly over at no charge. However, we reserve the right to ship up to 10% over or under on all orders.

Published prices are subject to change without notice. Intermediate quantities will be charged at the price of the immediately lesser quoted quantity. For example, if you order 3,325 pieces of an item and the next lowest price break is at 3,000 pieces, you will be billed the price per item for 3,000 pieces.

The union bug is not available on any of our products. Some products must be marked with their countries of origin. This is required by Canadian and US Customs of any product entering Canada or the United States. This marking may be placed on the product automatically, and may not be represented on any proof presented to you. Please be sure to ask what the requirements are for any product about which you inquire.

We offer only very limited and usually only partial credit terms to our customers in an effort to maintain our low prices. Deposits of 50% are typically required on all orders for which any credit is extended. However, we accept Visa, Mastercard, and American Express for payment. We also accept payment by cheque/check, EFT, ACH, and Wire. For orders requiring deposits or pre-payments, the order start date is the date on which all money due has been cleared and fully transferred into our account. Seriously delinquent accounts are referred to a collection agency for investigation and collection. Past due invoices may be assessed a 2.5% or higher finance charge per month, or the highest legal charge, where provided by law.

If you need help with artwork layout, we can usually help you at no additional charge. Just send us whatever artwork you have, and describe to us how you want your work displayed. We'll send you a tentative design at no charge, and if you have modifications to it, we'll just send you another. We cannot do intricate logo-design, but in our commitment to making this process as easy for you as possible, we're here to help whenever we can.

Artwork Types
We can accept most types of artwork you can submit to us however, in order to ensure there is no delay in processing artwork, which may occur with non-standard art types, we prefer vector art in specific formats. Please ask for our templates for use in designing your artwork. We prefer artwork in vector form, in PDF or EPS files. All artwork should be submitted in CMYK. RGB artwork cannot be accepted. When submitting bitmap (flattened) artwork, it should be 600dpi or higher, however, 300dpi artwork can be accepted. Bitmap artwork less than 300dpi is not recommended and is submitted at your own risk. Please be sure all type in vector artwork is converted to paths/outlines. Please be sure that all files linked from your art files are either embedded, or included separately. Files can be sent compressed in ZIP, RAR, GZIP, or SIT formats. When exact color matching is required, be sure to include all PMS numbers in the file and on your purchase order. Before your order goes to press, we will send you a bitmap-converted version of your artwork to confirm to you that your artwork has been accepted correctly. Please be aware that computer monitors cannot display the same colors that can be generated in CMYK printing, especially when not calibrated properly, so colors will be printed according to the information in the art files, and may not be perfectly represented on your computer monitor.

Damage in Transit
If you notice any damage that may have occurred in transit, please report it to us immediately, and be sure to document and photograph the damage.

Force Majeure
Neither party shall be liable in damages or have the right to terminate any agreement between the paries for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), customs delays, wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected.

Neither party shall be liable for any failure or delay in performance under this Agreement (other than for delay in the payment of money due and payable hereunder) to the extent said failures or delays are proximately caused (I) by causes beyond that party's reasonable control and occurring without its fault or negligence, including, without limitation, failure of suppliers, subcontractors, and carriers, or party to substantially meet its performance obligations under this Agreement, provided that, as a condition to the claim of nonliability, the party experiencing the difficulty shall give the other prompt written notice, with full details following the occurrence of the cause relied upon. Dates by which performance obligations are scheduled to be met will be extended for a period of time equal to the time lost due to any delay so caused.

Limitation of Liability
In no event will Blu Prime Playing Cards be liable to any party, in contract, tort or otherwise, for any loss of profits or business, or any special, incidental, indirect, exemplary, punitive, or consequantial damages, arising from or as a result of these terms, any order or any agreement between the parties relating to the products, services or deliverables provided, even if Blu Prime Playing Cards has been advised of the possibility of such damages.

You agree to indemnify, defend and hold Blu Prime Playing Cards, our officers, directors, employees, agents, licensors, and suppliers harmless from and against all claims, liabilities, losses, expenses, damages and costs, including reasonable attorneys fees, resulting from (i) any violation of these Terms, and/or (ii) any claim that an order from you, including any part of its design, infringes third party intellectual property rights, or that it is obscene, scandalous, or libelous. You agree to defend at your own sole expense against any such claim or proceeding that may be brought against Blu Prime Playing Cards.

Any claims arising under or in connection with your purchase, any order, or any transaction or product or Service provided pursuant to any order, shall be interpreted and decided in accordance with the laws of the Province of Ontario in the country of Canada without giving effect to conflict of law principles or any other law or principle which would apply the law of any other jurisdiction. Any suit, action, or proceeding involving Blu Prime Playing Cards and you arising out of or relating to these terms, any order, or any transaction or product or service provided pursuant to any order, shall be brought in the provincial or federal courts sitting in Toronto, Ontario, Canada, and Blu Prime Playing Cards and you both hereby submit to the jurisdiction of such courts for purposes of any such suit, action, or proceeding. No modification, waiver, or variation of this Terms of Purchase Agreement shall be valid unless it is explicitly modified, in writing, signed by a duly authorized officer of Blu Prime Playing Cards.
